    We have to take risk, we if want to some progess our I-140 cases.

    not necessary ...replacements are difficult for key jobs and expertise. if the right person leaves the job ..then a small / medium (or even large ones) can go off road. more than replacement ..it is the effort to find the right person, train him ..and for that person to go through the experience curve ..(I guess you are looking from your level ..are you in s.ware or in testing ?....if yes, you need to look at other higher levels ..ofcourse, for such people EB1 is available ..)
    but I agree ..it does not hurt US as much since economy is so huge ..but it can definitely hurt the business firms ..this was the main reason why the law was changed (or passed) ..to allow H-1 people to continue staying even after 6 years ..earlier they had to leave compulsorily..(I am not an expert ..so feel free to correct).
    and this can happen either at highly skilled level in a big company to a smaller business..
    for e.g. a restaurant can go out of business if their main skilled cook is forced to leave due to immi (or something else).
    and ofcourse a v.big company may lose a skilled analyst (and similarly a scientist etc etc)

    Thats one thing. Again we are talking of replacing these key people in NUMBERS aka thousands? So what does america gain?

    Hi,

    We filed for our I131 on 7th Oct, 2007. Yet to receive anything on them. My wife needs to travel to India end of this month. She needs her AP since she is on adjustment of status right now. We had filed for a service request on 7th Jan at Nebraska Service Center. Got an email from them on 8th asking for supporting documentation. We faxed the medical certificate for my wife's mother on 8th Jan.

    Now NSC customer service is saying that we need to wait for further decision. Spoke with our local Infopass office today and as per them we should get something in 3-4 weeks. They gave us an option of getting new AP at local infopass office by filing new fees all over again.

    Has anyone on this group faced similar issues? How do we go about getting approval once we file for expedited request? I though once we open a new SR, we should get something back within 5 business days? Any help would be appreciated.

    Bad news unless they allow mass conversion of TR applications into non-RIR. Imagine they took two years to get rid of 220,000 easier applications (2005 and 2006). Now they are left with some of the old TR applications and they must be thinking of how to meet the September deadline. I would not be surprised if they ask for an extension, citing processing difficulties.

    We have a one month window to push for HR 5882, let us focus on that. if it doesnt work then we have no hope. at this rate EB3 will not even move 6 months per year. In retrospect every minor gain for the EB community has had major implications to EB 3 and the backlog as a whole (just venting a bit, dont want to drag it into a big discussion). I remember last year there were many who were saying 'now that we have EAD and AP we are good', this year many will realize the additional pain of renewals and waiting.


    Oh's site mentions the following (per country limit is both family and EB based)
    "The numerical limits for FY-2008 are as follows: (a) Worldwide Family-sponsored preference limit: 226,000, (b) Worldwide Employment-based preference limit: 162,704. Under the INA Section 202(A), the per-country limit is fixed at 7% of the family and employment annual limits. For FY-2008 the per-country limit is 27,209. The dependent area annual limit is 2%, or 7,774.

    America does not need to do anything to get more workers. People will keep coming and it will always be a positive flow of good talent into America. The only Indians (and others) who might tell you that they do not want to come to the USA and the American dream is gone, etc., are talking bull and they know it. They will jump on a plane "the next minute" and come if the could. It's the same thing always: Go back Yankeee.................................and take me with you."
    That will never change. If it did we would not have IV forum or so many members.

    I am working with a bank for my new Mortgage. The bank is asking for 3 year continuous VISA (forward) as a requirement.

    My situation is H1 + 485 (I-140 Approved)

    my current H1 will expire in December 2009, I cannot apply for extension until June 09 (180 days )

    but Bank guys are asking for 3 yr VISA, they are not even looking on my H1b Approval letter as there is a line mentioned in there as "This form is not a visa nor may it be used in place of a VISA"

    Anybody have similar experience ? and any suggestions of how to approach / explain this to bank guys ?

    Appreciate ur views n comments

    Hello all,
    I have finished calling all the republicans from the list. here are my
    experiences. Most senator aides were patient and took down messages, i
    have listed the different ones.

    Senator Judd Gregg (R-New Hampshire) : does support high skilled
    provisions...*yay*

    Senator Michael Enzi (R-Wyoming) : aide was very patient and chatted
    abt legal immigration reform and took name, number, zip , msg to pass
    to senator.

    Senator Lindsey Graham (R-South Carolina) : went to vm twice. left vm

    Senator John Cornyn (R-Texas) : aide not very patient. asked to call
    my state senator.

    Senator John Kyl (R-Texas) : aide was very patient, and understanding,
    and had a chat about current immigration scenario. Senator Kyl is
    supportive of legal immigration, he intro/supported one bill for us in
    2007 but it failed to pass. He said that the senate politics is not
    letting high skilled immigration reform pass. he does not support
    amnesty, he wants border secured, etc before fixing broken legal
    system

    Please call and share your experience.

    Then why you are fighting for the spill over rules as they stand. Because its going to help you :confused:

    Read all the pages and let us know where anyone is stating to close the program. All we are saying is to close the loophole.

    Context is everything

    And people here are scolding and ranting against the program, not "loophole". But why even fight against the so-called loopholes? Don't we have anything better to do? Visa recapture is a much more worthy goal

    And BTW, a 30k salary doesn't matter for executives. Jerry Yang works for $1 a year, so does it mean he is not eligible? And what about the executives working for free for a noble cause? Not everyone is money-minded, and they may choose their goals and priorities

    People,
    I am preparing an article for NY times explaining our sufferings! Please contribute your thoughts.

    1. What is America losing because of our prolonged wait for Green Cards?

    2. How people who have green cards are contributing to the country as a whole ?

    3. What if the whole green card process takes less than 3 years ?

    Few obvious things are we would have bought a house, gone up in our carrier ladder, spend more and contribute to the economy, our spouse could have started working etc....

    I am looking for thoughts and experience other than the above things.

    USA is made by illegal immigrants (over 13 millions) and bonded labors (H1B - GC).

    Losses suffered by illegal immigrants and H1B-GC people fuels US economy (or at least contributes to that). My contributions so far might have been above half a millions. Indirect beneficiaris are top most companies.

    Why don't you listen to others on this forum? No one is out to screw H-1s and/or GC aspirants as far as the rebate is concerned. Read the previous post by gg10004. The law is not differentiating between a H1 and GC aspirant or a US citizen if none of them have a valid SSN. It is just unfortunate that H4s do not get SSNs. So stop getting paranoid.

    Moreover, your response that your title "No Stimulus Package to H1's and GC Aspirants - Again We Loose 1200$" is justified because titles are not for stories or whatever makes you look like an utter idiot. Titles are for accurately reflecting the gist of the thread. If you have an issue with adding 5 more words to reflect the reality, then add only one word: "No Stimulus Package to SOME H1's and GC Aspirants - Again We Loose 1200$".

    This, effectively, means that if the girl stops earning for any reason such as pregnancy or is unable to earn, she immediately forfeits the right to send money to her parents. This is the most illogical statement I have ever heard.
    And it also means that for any reason, if a girl remains a house wife, she has no right to send any money to the parents like you, as the earning member, do.
    This is the very strange attitude that may get a marriage in trouble.



    Did I even say husband shouldn't send money to his parents from his earnings?
    But shouldn't that be also need-based? How come it is the right of the husband to send any amount of money he wants to his parents without the wife complaining and how come it becomes a case of "taking for granted" when a non-earning wife wants to send money to her folks in need? This is a hypothetical situation and nothing to do with OP's case.

    And then how is it we, husbands, are the first ones to start complaining when our wives don't get a share of our in-laws property following their demise?

    And tell me then, following a divorce why are there laws which require you to split your net worth evenly with your non-working ex-wife? Is that acceptable to you then or you want to put forth an argument that "hey, we don't have a child and she is no longer my wife and so I am not obligated to give her a dime"

    My stand is based on the premise that a man is financially responsible for his wife and his kids and not to wife's parents! The point I was making is about a completely non working spouse. It is not about a wife that leaves workforce for medical reason temporarily.
    Let us not confuse the responsibility towards a man's wife and kids with that of in-laws!
    Using the same token, a man shouldn't expect/demand any property/cash from in-laws!
    I'm perfectly OK with humanitarian and need based help. What crosses the line, according to me, is that 'taking for granted' attitude!

    If the brother in OP's story is taking care of his parents, then this situation wouldn't have occurred. Look at it other way. If the man's parents are in need of money, it is better to ask the man instead of their son-in-law!

    A man taking a stand and be done with it has a better chance of saving a marriage than a man caving to the demand and building resentment. Hey, if a man is willing to please his in-laws in all possible ways, then who are we to stop him! Let him enjoy!!

    HSBC has rejected my refinance application because neither I hold a valid H1B nor a GC. They are rejecting, if you are in AOS not have one of the above docs. BEWARE. Don't loose time and money trying with this bank, if you are in this situation. I heard some success stories, with other banks though. Good luck.

    I'm sure the language should be worked out by USCIS as to whats best and whats not. Perhaps the "continous residency rule in US" need to be enacted. If a person leaves the country for a certain amount of time when on H1B may be > 6 months or 1year would loose his PD.


    But atleast the proposal need to be before the rule makers

    This would technically mean that anyone anywhere in the world now, who has ever been to the US on a H visa, can apply for a GC based on the first touchdown date.
