I talked to my lawyer and she says I can travel without AP as long as H visa is stamped. I just found Press Release on same topic from USCIS. Here is the link

    http://www.uscis.gov/files/pressrelease/HandLFinalRule110107.pdf

My wife is already in India; and I am going to follow her soon and we will be going to get our visa stamped.

I hope this reduces some frustration.

This is how this law is written. The limit of 140K is for a fiscal year. With next year having its own quota.

    USCIS cannot change the law.

This makes sense as well. Let us say if we had this limit for all of ten years in the past and only some of them hit the limit, then we will have this revolving balance which will keep getting carried forward and may total to 500000 or so by now.

No, thats not the intent of the law which is to restrict immigration in a given category in a given year.

My take is that Sen. Cornyn's bill is too ambitious and tries to solve ALL the problems. It is never going to fly, especially in this political environment.

We should focus on EB retrogression relief and try to get in only the absolute minimum relief needed to eliminate current backlogs.

In my opinion, this is the absolute minimum:

    1) Clear DOL backlogs in BECs
    2) Recapture lost visa numbers
    3) Dont count dependants
    4) Raise per-country cap to 10%

If we can only these rolled in to amendment, it should be easy to pass. We can start an awareness initiative to educate the senators and ensure it passes. If we shoot for too much, its next to impossible. Thats the sad reality.

Lets ask first ..to fix the USCIS lethargy..

First of all i want to say is nixstor cool down, you dont have to use bad words to say anything, even though you spell wrong people can read it right.

The whole name check system itself not working properly, everybody knows it, there are criminals who got clearance and there are innocents stuck for years, so its a chance to make FBI think about their system.

Yeah, tell me the same thing when all of us will wait for 6 or 7 years if they dont fix the system and continue to do security check on us. We know that we are NOT bad people. Its difficult to prove that in existing conditions. People are paranoid about every thing right now.

no. of h1b issued in last 4 years 65kX4= 260k
even if you double that (which i m sure is not the case), still it come to 500k.
    so ure over estimating it.
    thanks

What about L1-A and L1-B? They are a lot too. 192,000-60,000 = L1 number each year.

I keep reading we should fight for out rights and all. I am just curious
where does it say if on is on H1B or F1, he or she has a right to get a GC. GC or citizenship is a privilege, we cant demand it or force someone to give it to us. Its a simple demand and supply situation, there are more visa seekers then there is availability and therefore there is a waiting period. i am not sure why we don't accept the simple fact that there are way too many people from developing country like ours moving to US, and not everyone can be accommodated ASAP. i think US has every right to do what it thinks is best for her, even if we don't agree with that,
And those who say its discrimination, discrimination is when people from Bihar are beaten up on the streets of mumbai cause they are taking jobs away from marathi manus. Had there been so many techies from around the world taking up jobs in India, we would have seen street lynching.

    nitinboston,

If you feel you don't deserve a GC, we are fine with that.
However for most of the people on this forum, we deserve it.

Please watch this Aman Kapoor Video.
    http://www.youtube.com/watch?v=rqHz7IGoYWQ

"In order to ask for something, you should feel that you deserve it."

    It is that simple !

Agree. Truthinspector is simply expressing his opinion and if one doesn't agree, just put your side of the arguments to counter his but their is no need for character assassination. It's perfectly fine to disagree with someone but there are better ways of letting him/her know that.

truthinspector: may be it's time to invoke "freedom of speech" clause. ;) .. just kidding.

for all of you sharpening the knives to get truthinspector, let me start by saying that he/she has only mentioned their opinion and/or facts. they may not have been presented in a politically correct manner.

truthinspector never mentioned that the US has NO NEGATIVES........... purely stated why India is still not and (I am not sure about the 500 years - seems like an arbitrary number) will not in the near future, be a developed country and presented his/her reasons for the hypothesis..........

this forum is better served if you can show how and why truthinspector's list is incorrect instead of talking about self-confidence, self-esteem and all the other intangibles that you have no way of gauging without actually knowing truthinspector as a person.........

you are the one indulging in personal attacks, while truthinspector is only stating opinion and/or facts....

the truth always hurts. some more so than the others........

Unless india address issues of Population Growth ( now it is hard to walk in many places in big cities), Morality of the Peoples (govt can not do any thing about this, we as a people always take shortcuts aslong as it does not affect us personally !!!) Broken Judicial system ( Recent statement of supreme court tells they have enough court case to deal per judge for next few decades !!) Purity of air, water, milk, Increasing corruption and detoriation in quality of education (because of priviatization we have engineering , pharmacy and other technical education colleges in every village, 95% of them dont have faculty, labs etc and only care for profit, you can graduate as long as you pay fee for admission and pay fee for their annual due) (that is why our 90% of engineers are UNEMLOYABLE) THERE ARE many other issues to list here but all we know

If you go to our home country for short visit, you will probably like it , if you stay there more than three months and try to settle there again, you will start comparing all above to US and might feel that you made wrong choice of abondoning your GC process

Also in money we make in some big cities in our home country we can not buy a decent home to live in as real estate prices are so INFLATED and there is no body which regulates real estate in India. Prices double evey day. I dont know how local middle class which hardly make 2-3 lac per year can afford such properties.

After living long time in other country, it will be hard to adjust with people there. You will always face morality issue, duplicity in the people (what they talk and what they act, it is hard to trust) also artificial and selfish nature of so called social relations in home country (of which all we are proud of some how ) I find people and social relation here more frank and trust worthy (they are more open and close to reality) then our social structure where evry one try to take advantage of other some how under the so called social relations

So think three time about all these issue of long term before you try to abondon your GC process. All these isssues you will be facing in our home country no matter how much money you make. On long term your choice might hurt you. If you are fed up with immigration issues here try to open up other avenues for you along with this country.

This post is not entirely true.. I have never seen an college(recognized by AICTE) where u will pass only by paying fees.
There are issues in india , but i have seen many people going back , and settling without any problems. The choice to move is more personal , then what could be discussed here ..

I was in India recently for a 2 months vacation, and some work from our Indian office,. First few days were tough , lot of dust , traffic , pollution, But after 2 weeks i was loving it the old way .. and when i was flying back i realized I love Delhi .

If you own a house in the major cities ( ie lot of jobs and business opportunities) then going back makes sense. But if you belong to a small city , and have to move to a bigger city anyway, then living here makes more sense.

The reality (which is bad) is that if you have money in india , your life style is much better than what u have in US (dont forget , even earning 100K, doesn't really make u rich here , Honda and Toyota are poor people's car in US.. I have seen very few EB applicants driving a BMV,Bentley)

When i was in India, i went to best hotels for food (2000Rs buffets) virtually every week.,just went to NY once for a 200$ buffet, in 6 years.

So everyone has to take a personal decision, based on personal factors..

    45 DL Received: December 2005
Current Status: CERTIFIED (On 12/15/2006) per DOL website.

Can anyone tell me what happens next?

You should receive the approval papers in a few weeks...
In case you donot, you have to follow up with PBEC...
If you donot get anywhere with that followup, there are some people who filed I-140s without the actual paper. In that case the USCIS sends a RFE to the PBEC.....

Like many immigrants, I moved to USA in search of American Dream. With a degree in Computer Science and valuable experience, I thought I could pursue my ambition to excel in my field, while also fulfilling my American Dream. My dream of America was about freedom. Freedom of working at niche companies, living a comfortable life, earning higher wages than what I used to earn in my Home country. What started out as a dream has turned to a nightmare. Like many others I came to USA on H1-B and wanted to convert to a permanent resident. The process, which used to take 2-3 years, has turned to uncertainty. The path for Permanent residency has been entangled in complicated government laws and bureaucracy. I had to wait in line for 4 years just to get my labor application approved and now I am struck in another queue of retrogression. I moved from my country; because I did not want to wait in line at Ration shops, bus stops. I wanted to escape from the lines, but now I am struck in a bigger line with no end in sight.

Whenever there is a discussion about immigration, People always assume it as about illegal immigration. So I have to keep reminding people that there is another side to immigration. Legal immigration. The issues of legal immigrants have been ignored and been buried in the midst of illegal immigration controversies. When I send letters to House Representatives/Senators about the problems of legal immigrants, they reply back about increasing H1-B numbers. Legal immigration is NOT just about just increasing H1-B. Also the anti immigration groups publish that people on H1-B dont pay taxes. But we pay taxes, Medicare and social security like all other American citizens. With the current immigration laws, we might not be even to avail the benefits of these taxes.

The facts of the legal immigrants

We are NOT here to take American jobs. We fill those positions when a suitable American citizen was not found
We PAY TAXES like any other American citizens
We are here legally. The government has assessed our qualifications and education.
According to Economic Report of the President, 2006 - Legal skilled immigrants increase productivity growth and improve the standard of living for the U.S. population as a whole.
According to Economic Report of the President, 2006, skilled immigrants constituted 76% of the employment growth in the Executive, Managerial, Professional (e.g., Scientists, Doctors) and Technical (e.g., Health and Science Technicians) categories from 1996 to 2002.
According to Annalee Saxenian, Silicon Valley's New Immigrant Entrepreneurs, Public Policy Institute of California, 1999, in 1998, Chinese or Indian CEOs ran 24 percent of Silicon Valleys technology firms. These companies accounted for over $16.8 billion in sales and 58,282 jobs. These numbers may still understate the scale of immigrant entrepreneurship in the region because firms started by Chinese or Indians with non-Asian CEOs were not counted.

We are being backlashed by the congress and the anti immigration groups, even though we are highly skilled, well educated and staying legally. We have done nothing but help America in its economic growth and in its quest for innovation and technology. Now we are being punished for being here legally and law abiding by putting us in retrogression. We cannot get Salary hike, or promotions when our green card is in process. So while my American colleagues have moved to greener pastures, I am struck here at the same job and same salary. People struck in green card process cannot open new ventures. The new ventures would open new jobs and increases Americas competitive edge in innovation and global leadership in technology. If American congress does not act at this point of time, there will be a BRAIN DRAIN. People fed up with retrogression have already started looking at other countries like Australia, Canada who are welcoming high skilled immigrants with open arms and easy migration laws. As for me I have invested my prime youth for my American dream and hope American government will embrace high skilled immigrants like me. Rep. Shadegg has tabled H.R. 5744, SKIL bill for legal high-skilled immigration. This bill would reduce the current wait time for getting the green card. I sincerely urge congress to pass SKIL bill which will reduce the wait times and help high skill immigrants help America to sustain its edge on technology and global innovation.

We are getting more calls for op-eds and need more IV members to pitch in and write articles.

As someone else pointed out, if you don't drive will he/ she won't get a H1B?

    This does not make sense.

I just renewed my DL in and BMV did not even ask for my visa/ passport validity and they issued me 5 years renewal (my visa expires in Oct 2008).

I can understand that based on your visa expiry date, BMV may issue only limited time DL.

I know each state has jurisdiction on these matters but there should be basically similar approach.

    Stuck for years
In the debate over illegal immigration, don't forget the many legal immigrants waiting for their turn.

    by Pankaj Kakkar

Legislators in Congress are as divided over the issue of illegal immigration as Americans are. Opinions are strong, debate is passionate, and no end is in sight. Proponents of quick reform, from both sides of the divide, stress the urgency of the issue and the need for a solution soon. In this debate, however, the plight of legal immigrants is forgotten.

The path to legally acquiring US residency and eventual citizenship is long and unnecessarily complicated, yet many deserving immigrants attempt it every year. Legal immigrants are roughly divided into two categories - family based immigrants and employment based immigrants. These immigrants face years of waiting due to anachronistic laws, discriminatory quotas, onerous bureaucratic hurdles and paper files needlessly being pushed through the system. They also face mounting legal and other tangible and intangible costs. Through all this, they work hard, pay their taxes, and live upright, lawful lives. It is in the interest of the United States as a whole, and Americans individually, to expedite the immigration process for both employment based and family based immigrants.

The benefits are easier to see for employment based immigration. This category has attracted the best researchers and entrepreneurs of the world for the last half century. Immigrants from this category have started companies that employ hundreds of thousands of Americans (with some of these companies featured in the Fortune 500 list). Others have done research and invented technologies that have earned them the highest awards in their fields, such as the Nobel Prize. Even those who haven't been as successful have been an indispensable part of America's economic growth and progress, especially in technology, over the last half century. In my country of birth, India, the phenomenon of the best minds leaving for the US was called the "brain drain" - it isn't hard to see that India's "brain drain" is but America's "brain gain".

Family based immigrants also benefit the US, although in less economically tangible ways. The best minds of the world, immigrating to the US through the first category, would be most comfortable and most productive in an environment where they're close to their family. These family members themselves contribute to American society by being productive, law abiding, and patriotic citizens.

Typical legal immigrants have to wait 5-10 years, and some family based immigrants as long as 20-25 years, before they can even get a Green Card, after which another 5 year wait for acquiring citizenship ensues. These long waits have already persuaded several potential immigrants, many of whom could have been founders of Fortune 500 companies or Nobel Prize winners themselves, to go back to their countries of origin. Quite a few have also immigrated or are considering immigrating to countries where immigration laws are friendlier and less bureaucratic, such as Canada, Ireland and the U.K. While legal immigrants benefit the United States greatly, America does them, and herself, a disservice by making them suffer through an interminable immigration process and countless bureaucratic hurdles. America can and should do right by them.

Congressman Shadegg (R-AZ) has introduced a bill, called the SKIL (Securing Knowledge, Innovation and Leadership) Act, in the House of Representatives. This bill, which has 9 Republican co-sponsors, including Congressman Mike Pence (R-CO), a leader on the issue of immigration, will significantly ameliorate the wait times and hurdles that legal immigrants face, while also benefiting the American economy by making sure that the technology leaders of tomorrow innovate and invent in the United States, and not elsewhere in the world. A similar bill has already passed the Senate. The House should consider it soon, and pass it as well.

    Great news for EB2 folks.
If EB2-I moves to June 2006 then EB2 C will almost be in the same or better position. So June 2007 bulletin folks aka EB2-C (Jan 2006) will be the main beneficiary. EB2 I folks who are lucky with RD before the current processing dates (mid July) can expect surprise mails. Good luck
