New numbers are out on H-1B usage and the past week showed a substantial pickup in usage with more than 1700 numbers counted against the cap of 65,000. 36,600 H-1Bs have been counted now. I'm moving my exhaustion projection date up about two weeks. My target is based on a rolling four week usage average so variations from week to week are discounted. I am currently waiting on my 485 (EB2). My priority date is Sept 16 2005, and 485 date is Aug 27 2007. I have traveled out of the country and back on advance parole and am still on H1 as I am still with the same company. My current advance parole ends in Jan 31 2010. I have to travel again in the first week of Feb 2010. I applied for another advance parole at the TSC on Aug 31 2009 for both my Wife and I. My Wife got her parole in a week, but I am yet to receive it.
I checked the USCIS site for the time frame and it says 3 months for TSC. I am thinking I might not have received it yet as I have a parole which is active. But I want to make the travel reservations now and I wanted a confirmed parole. USCIS said that they could put in an expedited request for the parole if it is an emergency. My lawyer says not to worry as I had applied in August, I had plenty of time to receive it.
Please advice. What should I do.

Guys,
I am on L1 .My wife is working for a Indian s/w MNC and was earlier in L1.Once her project got over they sent her to India.She applied for vacation and came here on L2.During visa stamping the officer cancelled her L1 visa in passport.We applied for her EAD in July and are expecting to receive it in a few days.This is the first scenerio.
Secondly, we applied for 485/140/AP/EAD in the second week of Aug 07.No updates yet with regards to cheques/receipt notices etc.
We tried to contact her company's office here to look out for employment based on L2 EAD.But they mentioned that they wanted her to goback and come here again on her company visa.I really cant understand what is that for.
Now the question is
1.Is it safe for her to change to L1again and have visa stamped in India given our situation of GC.If so when.I mean after receipt notices/finger printing etc etc?
2.Any idea of y these companies doesnt employ their own staff who are in EAD.
Any one gone thru any of the above situations.?

My wife received Appt. letter for FP second time. It mentioned that first time FP didn't pass thru FBI check, se she need to come again at no cost. Is this normal and did it happen to any one? We are in Atlanta.

Dear experts/Attorneys,
Please help me. My EB2 priority date in 21Nov 2007. My I 140 is approved and yet to file for I 485. Now at work I have promotion offer from Sr developer to Team lead. Technologies I work for won't change, but I have to change my work location to different state in this case
do I have to file for PERM and I 140 again?
If I have to file 140 can I retain priority date?
Is there any other option for me to escape PERM refiling other than not accepting promotion :)?
Your advice is greatly appreciated.
