They could have done this and re-captured visas with additional fees or whatever. And called it greencard fraud fees it that makes them happy. But the fact is they did not want to do anything to give relief to Immigrants. Recapture (hundreds of thousands of visas) would have significantly helped helped retrogressed countries like EB3 India, China, ROW and EB2 India China. They can take additional fees as long as we know the recapture is being done.

The news about these amendments really lightened up our suffering retrogressed souls.
But its really unfortunate to know that President Bush is gonna veto the bill altogether.

Hope same kind of amendments are offered in other bills with high sucess rate of passing.
These few days are critical since November 16 is the adjournment date for Senate and no immigration bills will be approved in 2008.
We cannot wait till 2009 or later. Please save us from this hell of retrogression.

When I started my process in 2005 I was told that the whole thing will take 2-3 years. It is almost 4 years now and based on the VB movement for the last few months I have been thinking that this process can easily take 6-7 years and now DOS says it may as well take decades for those born in India. :mad:

Hi All,
I want to know if my 19 year old son can be affected by aging out.
I have just received ALC certification and will now file I140 and I485 concurrently as my priority date NOV 22 2004 EB3 Rest of World will be current in June.
Can someone who understands the aging out rules tell me if my son may have a problem?

can you please suggest accountant, if its ok with you, residing any place is fine as we deal most of it through ph, having tough time to find the right one just to aid in the start up and maintain min. proceedings like tax filing etc. without having any activity/revenue
I have used the following accountant for years now, The best part is that he is familiar with Immigration issues or gets it validated from an immigration attorney, who sits in the same building.
Please note I am not soliciting for him but reffering him based on request.

The calculations below is not to scare anyone but it may very well a reality. Based on the assumptions below, some people may have to wait up to 20 months to get a EAD card: Ouch!
A Total I-485 Applicants: 750000 Applicants
B Each EAD processing time: 5 Minutes
C Total processing hrs: 62500 Hours
(Calculations: AxB/60)
D Daily productive Hours: 5 Hours
(It is a government body!)
E Total Man Days (Business Days): 12500 Man Days
(Calculations: C/D)
F EAD Workforce: 30 People
G Total Business Days: 417 Days
(Calculations: E/F)
H Average Business Days in a month: 21 Days
I Total Clearing Time : 20 Months
(Calculations: G/I)
I will cut no of EAD applications to 600,000.

Actually nurses have the H1c visa, but there are only 500 a year and only 14 hospitals in the whole country can apply for these visas. These visas last 3 years and after that the nurse has to leave the country. Not that employers don't want to apply for visas, it is just that many nursing positions DO NOT qualify for H1B! So the only viable option is the GC

These are also the occupations that represent the most vital human capital of the 21st century for US economic competitiveness. Many of these people are US educated atleast in part and are currently gainfully employed and contributing to this vibrant economy.
Unfortunately the current immigration policy is doing a great injustice to this group of individuals who have quietly and patiently been waiting their turn. Many have waited 5-10 yrs and are still awaiting their green cards. The current backlogs are ominous.
Many have organized into a grassroots organization called Immigration Voice and are planning a pro legal employment based immigration rally in Washington DC on Sep't 18th. We would appreciate coverage of this first of a kind event which puts the spotlight on a just cause which for far too long has gone ignored by our lawmakers.
