Hello,
I have read in the popular immigration forums that one can request a one time 3 year extension to H1b beyond the standard 6 year limit if one has an approved I140 and could not file I485 due to retrogression. I am confused on how does one go about requesting this..meaning is it sufficient to just put three years under the 'date of intended employment' in I129 form and have a labor condition approval with similar dates or do you have to include a copy of approved I140 and point to the 2005 Aytes memo that grants such a provision while you file for I129. By the way the situation is also a bit more complicated due to the fact that I am changing jobs (5th year H1) and trying to get a 3 year transfer based on approval from the company I am leaving.

Roll Call has an interesting analysis of this. Some Democrats believe that they have the votes and they can use immigration reform to brand their party as the true home for the country's Hispanic voters only if they leave the GOP out of the process. And most in the GOP will probably be fine with this except the small number that understand just how dangerous it is for the future of the GOP to be branded the anti-immigrant party.

As long as your company is generating Paystubs you are not outofstatus. but if there is an audit and if INS finds that you have not paid then its will be an problem.

it is possible (answering a question you directed towards Kirupa)

Gurus..I need some help
My I-140 is approved. I recently got 3 year extension and I am in my 7th year currently.
I may get a better offer. My question is
1. Since I have a new H1b which is valid for 3 years (for H1b year 7,8 and 9), can I transfer it to a new employer?
2. Also, the new employer is willing to file GC, can I use my old PD date. (the new job profile is similar)
3. If the current employer withdraws my I-140, will that affect my H1 transfer?
Please help.

My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!

H1 Company is based in Phoenix with another office in delaware.I have gievn my address from NewHampshire on my LCA and NJ on my I 140 application.I work for a client in Newyork.I have given my address in New hampshire as I was not sure that my project will be for a longterm and gave my cousins address in New Hampshire for LCA.
I got an RFE asking why I have different addresses on my LCA and I140 while my company is based out of Arizona and Delaware.Please suggest how I should be answering this.

I sent my I-140 on Apr 16, premium processing. How long does the premium processing take? I have to leave for India in a weeks time, and wanted to know if I would receive it in time.

There is no such thing as AP Renewal, it is always a fresh application. That is the reason application does not mention anything about renewal.
