    it asks last five year employment history , i have not worked in USA for the past 3 year but i have worked abroad before these 3 years.. should i write it in the column or i should write NONE as i have not worked here in USA .... i am not the primary applicant ... my husband is primary applicant

    Hi All,

    I am a bit concerned that my attorney wants to send the response to my RFE to the courier address for TSC rather than the po box listed on the gold sheet. Is this ok? Will the response reach the right place? They always use FedEx so they are saying that this is how they will send it.

    People who had an EVL RFE on their 485 from TSC please respond.

    I spoke with TSC Rep today. I called up to re-check what lot of other guys are saying here that TSC no longer is honoring 180 day namecheck rule mandated by court few months back.

    TSC Rep said she has no idea about 180 day rule but knows about FBI/USCIS joint effort for clearing name checks pending more than year, 2 years etc.

    So atleast, my call suggested that some people at USCIS have no idea about 180 days rule mandaged by court.

    My understanding is, you don't have to. AOS is a valid status until there is a yes or no decision on your 485 applicaiton from USCIS.

    Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...

    Keep an eye on the military appropriations bill Congress is working on for a potential immigration piece. The AP reports that Republicans want some serious money and personnel commitments for the southern border. And my own sources are telling me that some Democrats are looking at trying to get the DREAM Act in that same piece of legislation. Remember, DREAM allows for some who join the military to pursue permanent residency so it would be a germane part of the bill. A down payment on comprehensive immigration reform? Or the end of that effort and the return to piecemeal legislating?...

    There is so much dysfunction in USCIS. See the complaint to investigate this problem. There are folks sitting from 2001/2002 and USCIS does not bother about their petitions.

    Canadian-born Justin Bieber is today's selection in honor of my teenage daughter who went with her girlfriends to hear the 16 year old singer here in Memphis over the weekend. Bieber has the distinction of being the first artist to have seven songs from a debut album listed on the Billboard Hot 100 at the same time and his second album debuted at #1 on the charts. Bieber's discovery was also very 21st century. He was picked up for a recording contract after being discovered on YouTube.

    My employer was planning on sponsoring me, and paying all the filing fees, but the deal was that I was going to pay the lawyer directly for the legal fees. I just found out from a second lawyer that technically we can't do that because it will drop my salary below the prevailing wage. Is there anything I can do to get around this, and still pay the legal fees? Is it completely against the law for me to pay them or is that just an "interpretation of the law"? The other possibility is my husband could pay the fees, but I don't know if that's allowed either.

    Let me know if you have any advice - we have to have everything signed by this Friday.
