What are the requirements for using this. Can one exercise this option, if still available in the following scenario when returning from canada - H1 expired, H1 extension filing pending, no receipt notice received yet for H1 extension filing, and I-485 pending.

The reversal that they are talking about is the July02 bulletin that said that they will not be accepting any applications as for the bulletin that came out in June for the Month of July (where the PD's were current). Nothing to worry about. Relax and continue with your filings. :)

My first H1 was from "Company A" back in 2001. Company A also sponsored me for my green card. In 2005 I transferred my H1 to Company B, however my green card was still sponsored with Company A. I have an approved I-140 and I am waiting on my PD to become current. My H1 is suppose to get renew in August of 2007, which will be through Company B.
I have heard that after 6 years renewal, your current H1 company should have sponsored you for green card in order to get the 7th year H1. And as you can see in my case that my previous company has sponsored me for my
H1 and not my current company.
Can someone put some light on this issue.

I want to change my employer from A to B. B has filled for h1b transfer on 26-sept-2007 (I have fedex tracking number). Till today (9-oct-2007) we hv not received the receipt notice.
My expected start date was 1-oct which has been extended twice, i.e 8th & then 15th. If receipt does not come will 15th, then can I join the new employer?
Is there any way I can find out the file position/status using fedex tracking number?
Can new employer file one more application for h1 transfer under premium process?

Hi All,
Please share your experience. This is quite urgent. My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.
Questions
1) Now is it ok to file H1B with new title? What if H1B gets rejected?
2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?

You can enter all the data, save it and book your date as and when it becomes available. I did it recently for Chennai. But, if you do not book the date within one week of saving your forms, you have to enter the data once again. For Chennai, they normally open the dates 3-4 weeks in advance.

I am going on an international travel on job for 1 month during my OPT period. My OPT started in Jul 3rd 07 and I am planning to travel in the month of jan 08.
What are the documents that I need to procure for making my trip possible. Also, if someone could comapare this situation with international travel in H1 status it will be great help.

Your wait really starts when you gets your I140 approved. After that you can do all is to wait for 8/9/10/11 dates every month to watch the visa bulletins [:(]

Hi,
I had a question regarding employment in OPT STEM extension. I recently(one week back) got a job and joined as a independent contractor(adding me as a vendor to company and at the time of joining they asked me to fill W-9 form) in company. I was joined first and thought of ask them to enroll in E-verify later.
But couple of days back when I ask the HR for company to enroll in E-Verify in order to update to school officials. HR refuses to enroll because as I was working as an independent contractor and not coming under their payroll.
Regarding how do I get paid? They will pay me bi-weekly. But I need to rise the invoice and submit time sheet and give it to them so that they will pay me a payable check.
And even I got approved OPT STEM extension couple of days back which I was applied through my previous employer.
Is there a way to come out of this situation?
Even thinking of adding a consulting firm layer in between the company and me but I don't want to do that. Please help me out.

My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?
- My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?
- Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?
