Hi,
I got offer for "Manager - Production Support" from my current company where I work as Tech Lead. I know there are issues with job code. I ran this through my attorney and this is her response:
"This would be considered a "material change" in your job for
immigration purposes. You can only make such changes after your green
card application has been pending for 180 days."
Is above correct? Has anybody accepted managerial position while I-485 is pending? Please advice.

My I140 (Bachelor degree, EB3, PD: Nov'04) was approved last month from my previous employer.
I completed my MBA in Jun'06 and joined another company; my job description has changed totally and I can't use previously approved labor for my new job. My new employer will initiate the process of labor, next week.
I checked with my previous employer and he informed me that he is ready to give me a support letter, if I want to go ahead and file I485 based on EB3 I140.
Questions:
Is it possible to file I485, even if we are not working with the employer?
Once I have filed I485 based on my EB3 I140, and if the application remains pending for next 6 months, is it still possible to port the PD (Nov'04) to the new EB2 based petition?

The AP document should say that you can be paroled until ABC date. That is the expiration of the AP.

Great news! The Hatch widows bill (which removes the requirement that a couple must have been married for two years before a US citizen dies) passed and included in that bill were provisions extending the religious worker green card program and the Conrad 30 J-1 physician waiver program. Each of these programs were extended for three years. The EB-5 regional center program for immigrant investors was permanently reauthorized by the Senate yesterday. The House must agree to these amendments before they go to the President and I do not yet know whether the bill will go back to the House...

I was on h1 then went on h4 for 6 months and then 10 days back applied for h1 in premium processing and got approval today. what is amendment process?

Guys, we should have more rallies like the SJ one in bay area.. the next target can be San Francisco - Civic Center.
There are many official bulidings like City Hall here and we will definitely get heard again.
I always suggested for this type of gathering on roads so as to get heard. THIS WAS A JOB WELL DONE by people who attended and organized.
Finally to gsc and others, save banners and material from the the SJ rally so that we dont have to start from scrach.
For the people who didnt make it, please attend the next one no matter what.

I�m currently on H1B, I'm planning to go back to my country for an extended period.
Few queries
1) Can my employer keep my H1B open and show that the job is available for me? If so, for how long can employer do that?
I may go for six months, year or more, depending on circumstances.
2) If after a year a new H1B is filled, by the same employer (given that old H1B cannot be opened for long) will I be able to utilize the old quota or would have to file in new quota.
3) If I come back after a year, does the 6 year counter restarted? ie. the limit of working for six years on H1B.
4) If my employer cancels my H1B, and after six-months or a year, a different company files a petition for H1B, will the petition fall in old quota? Or will have to wait to be filed in new quota for that financial year?
If someone could answer my queries and help me decide, it will be very helpful.

Does any one knows why EB2 India is not approving in comparison to 2006.
As my understanding that USCIS should process application in FIFO and PD.
My PD is Feb 2005 and when I talked to CS he told me that everything is cleared and my case should be approved .
He told me to call after 68 days ( don't know why) if my case is not approved till then.I am seeing peoples with 2006 PD are getting there GC .

Applying for SSN doesn't invalidates your H1..

yes. it can be done inside USA by filing I-539.
The school must first issue I-20. Then, you can file I-539 with the INS by attaching the I-20.
INS will approve it and return you I-20 along with a new I-94.

My wife received Appt. letter for FP second time. It mentioned that first time FP didn't pass thru FBI check, se she need to come again at no cost. Is this normal and did it happen to any one? We are in Atlanta.

If your 140 is approved the chances of 485 denial are quite remote. however most attorneys recommend that you try to stay on H1 as much as possible

In its press release, USCIS did not state how cases filed and rejected on the 2nd are to be handled other than to say that properly filed applications would be accepted. This presumably covers the many cases filed after the second that were held, but it doesn�t explain what will happen to the cases received earlier. We hope USCIS will issue special instructions to issue July 2nd receipt dates to those who are able to document they attempted to file. We presume some folks are still waiting on their July 2nd cases to be returned and are debating refiling new cases rather than waiting. Unfortunately, there is a risk of not getting the package back before August 17th and some people will need to refile without proof of the earlier filing. Hopefully, again, USCIS will institute a process for such individuals to avoid being penalized.

Company A has filed my 485/EAD/AP. I am planning to change company B on AC21 after 180 days. Can I use AP which is filed by company A, for travel purpose after switching to Company B?

If your EAD is based on your husband's I-485 app I don't see any reason as to why that should affect your gc process if you move jobs.

Just need some suggestion:
I may be on the chopping block next week..
currently am on my 8th year H1, expires march 2010..so less than a year to restart..and be back in the line. (spouse on H1)
My 140 is pending...
so if i lose my job.. can i go to H4.. even though i have stayed here for more than 6 years..
and in case if i get job ...can i get back on H1 and restart GC?
i am thinking.. i have come to the end of all options.. and the only course available for me is back to desh..any inputs..will be appretiated..

You should pay taxes in PA.
In case your employer is running the payroll from MI, then file MI taxes as Non resident and PA as resident. You will get credit for paying non resident taxes in MI on PA's state tax form.
Don't pay resident taxes in the state where you are not staying. I got this info from a HR block tax consultant..
