Hello All,
I live in the Bay Area, California and wanted to travel to Canada for getting my H1 stamping done. Has anybody done the stamping recently in Canada? How was the experience? Also, we were thinking of Mexico initially but changed our minds due to border issues/swine flu fears. Anyone done it through Mexico recently? Please share your experiences.

Please provide a ready reckoner on AC21. Like the basics. This would help lot of people trying to switch employers including me. I know there were memos written by Yates and other lawyers. Your real experience on this matter always counts and helps people.

The Los Angeles City Council has approved a measure barring city workers for traveling to Arizona on official business and also banning the city from contracting with Arizona businesses. Some contracts for key infrastructure items are not affected, but the LA Times estimates that the vote will cost Arizona upwards of $8 million per year. The biggest contracts not affected are those involving the airport and sea port. But the civilian panels overseeing them are considering canceling contracts worth $26 million. On Monday, Boulder, Colorado will vote on a similar measure. San Jose votes next month.

There is a retrogression in perm process..only those who came to this country before 2000 can file for PERM.

If you are having the valid visa, there is no need to go for stamping again. While entering you can show the H1B approval so that you get the I94 till the date on the H1b approval.

Good question. I'm not sure if the two-year home residency requirement applies to tourist visas.
But if your J-1 program isn't subject to the two year residency requirement, I don't see why there would be a problem.

You should change to H-4 (assuming you are eligible) if you are not working. You should be able to change back H-1B later and get the remainder of your 6 years, without being subject to the cap, if you find a new employer. It is important not to violate status now, and not working violates your H-1 status even if the lack of work is not your choice.

Some are saying that the downturn in H1B applications this year could be as much as 60%. As a result of this decline, there are predictions that the quota will not be reached within the first few months of this year. Rather, many suspect that the bachelor's quota won't be reached until the middle of July, and that the master's quota won't be reached until later this June.
We shall see how the number will play out in the next few months.

We filed for our 2nd AP on July 2nd. They received it on 8th and mine was approved on 22nd. Got my AP yesterday. No idea what happened to my spouse's. I got that RN from the back of the check and called USCIS. I entered the 10 digit RN and it said not enough numbers entered?? So i called again and said no RN and i got a cust service rep. I gave her the RN and she said they received it on 8th and is still processing it. She said it doesn't matter whether we filed together and asked us to wait 6 months.
Is this normal? I just hope the other AP is not lost.
Also since there is no expiry date on the AP, is it to be taken as its valid only for 1 year from the date of issue? We never had to use our 1st AP.

Hi all,
My ETA case in online status shows "DATA REVIEW" for the past 5 months, my PD Aug 04/RIR/EB2 is with Dallas BPEC.Initially the status was closed, and then opened. After 5 months of reopening it still says 'Data review' .Is there some thing wrong or should I talk to my lawyer.
Some of my friends who applied that time have their status 'in process' or even 'certified' .Any experience like this or will that go to certified from here directly or to "in process" first. How long it can be in each of these statuses.
Any ideas appreciated please!

PIC countries benefited from unused visas a lot till now to have their PD current/move up. So based on that benefit, Also one thing is clear the unused visas if available are country indepedent and are used at the rate of 27% per quarter.
so for example 100K visas are available (which i would enjoy having )27K per quarter is available from the start of the year . Now among this 27K how is the distribution, can it be distributed whichever applicant needs PD IRRESPECTIVE of EB1,EB2,EB3(skilled, professional) Vs EB3 other or does it split by the calculations of EB1, EB2, EB3 with 28% EACH and EB3 other NOT above 10K limit

My H1 is still pending..RFE on Oct 1st and employer replied..but staus is still same saying RFE sent..case on hold..
can I go for OPT Extension now as my current OPT dint end yet??
Do I need to work in this current OPT to be qualified for OPT Extension or is it sufficient if I have an offer from my employer and he is E-verified??
Looks like some of you got approval for OPT extension..so please help me by posting how you applied..
Let me know of legal stay during these times..

Just wanted to get some feedback whether its possible to get i-140 approved using an old approved labor ?
- Case:EB3 ROW.
- The company A merged with B. (may be a successor-in-interst)
- Labor from B approved in 2005 w/pd=2005
- Labor from A approved in 2006 w/pd=2002.
- I-140 using 2005 LB approved with B
- Lawyer suggests to use the A's 2002 Labor to file a new i-140 under company B. He says that as per some law the old labor is still valid until end of this year. Please advice.

You just need your approved EB3 I-140 notice
You need a copy of the approved EB3-140. Original is not required and you will not get it either. A copy should be available but depends on whether your employer/lawyer shares documents with you or not.
